Julia Fischer, represented by KünstlerSekretariat am Gasteig, Montgelasstr. 2, 81679 Munich, Germany, is the operator of the website (hereinafter: "Website"). Via the website, Julia Fischer offers information and news on the artist Julia Fischer and audio and video streams with current performances of the artist.

 

The operation of the website and the implementation and optimisation of the services offered by Julia Fischer in part require the collection, processing and use of certain personal data. Julia Fischer attaches the greatest importance to data protection and data security and observes the relevant data protection regulations in accordance with the EU General Data Protection Regulation (GDPR) and Germany’s Federal Data Protection Act and Teleservices Act.

 

If and when necessary, you will be asked to give your consent in terms of data protection law in connection with the use of this website. In this case, you give this consent to Julia Fischer by ticking the appropriate box, allowing Julia Fischer to collect, process and use your personal data to the extent described below. You can revoke your consent at any time. The revocation can be sent in writing to KünstlerSekretariat am Gasteig, Montgelasstr. 2, 81679 Munich, Germany, or in electronic form to team@ks-gasteig.de. After the revocation of consent Julia Fischer will immediately delete the collected and stored data and will no longer process them.

 

In the case you provide data of third parties, you assure Julia Fischer that these persons have knowledge of the process and that they agree with the process and accordingly also with the appropriate collection, processing and use of their personal data.

 

I. Collection and Storage of personal Data 

Julia Fischer collects and processes data to a certain extent when you use the website or register for the JF Club.

 

  1. Inventory Data

 

No prior registration is required for the mere visit of the website. You can therefore visit or use the website without us needing any of your personal data.

 

In order to use the paid services of the JF Club, a registration is required. At the time of registration for the JF Club, Julia Fischer collects and stores the following data:

  • e-mail address
  • self-defined password
  • surname
  • first name
  • street
  • post code and location
  • country
  • payment data (e. g. credit card number)
  • language settings and data for the selected subscription

 

Julia Fischer collects, stores and uses only the data necessary in a given case for the execution and billing of the respective service, the registration or for making contact with you.

 

If a particular payment method requires an external payment service provider, you may be required to provide additional data to this provider (such as the payment service provider Stripe) or already may anhave done so in the process of creating the account. In these cases, the data protection regulations of the respective payment service provider apply. These possibly provide the transmission of certain data to Julia Fischer as part of the payment process.

 

  1. a. Julia Fischer will use the above personal data for enabling the registration, executing the contract and providing the respective services.

b. By registering, you also agree that Julia Fischer is entitled to use the data you provide to Julia Fischer (and in particular your e-mail address) for her own product and service development, customer relationship management and marketing purposes, in particular for e-mails containing information about new offers in the JF Club and other products, services and offers by Julia Fischer. You can cancel newsletters at any time using the link in the respective e-mails for this purpose.

c. Apart from that, Julia Fischer will only use your personal data if you have given your consent for the type and scope of the specific use, or if there is a lawful basis for doing so.

 

  1. Usage Data

 

When the website is used, Julia Fischer also collects and stores the following usage data without registration or data being accordingly entered:

 

a. Log Files

 

When the website of Julia Fischer is accessed, the following information is automatically logged by the web server:

 

  • Browser type and version
  • Operating system used
  • IP address of the computer requesting a page
  • Date and time of the request
  • Website from which you are visiting us (Referrer-URL)
  • Website that you visit
  • Access method/function specified by requesting computer
  • Input values transmitted by the requesting computer (e. g. file name)
  • Access status of web server (file transferred, file not found, command not executed, etc.)

 

This information is used for the purpose of identifying and backtracing unauthorized web server access and other criminal offences, as well as for the purpose of statistically evaluating the data in the event of errors or for optimizing the website and services. Julia Fischer learns, for example, at what times the website is being used most intensively, how the navigation within the website proceeds and which services or sub-pages are of particular interest.

 

This anonymous data is stored separately from any inventory and content data you may have specified, and thus it is not possible to draw inferences about a specific person. After evaluation, this data is deleted.

b. Cookies

 

Julia Fischer's website uses cookies. These are small text files stored locally in the cache of your internet browser, allowing the recognition of the browser, and through which Julia Fischer is provides with certain information. For example, they enable providing suitable information or to recognize your language settings and thus will make the use of the website more comfortable. After the session ends, this data is removed from the session; the session cookie is deleted.

If you wish to prevent the use of cookies, your browser offers the possibility to prevent the acceptance and storage of new cookies. You can find out how this works with the browser you are using, e.g. from the help function of your browser. For such browser settings, Julia Fischer cannot warrant that all features can be used without any restrictions.

 
c. Google Analytics

 

Julia Fischer's website uses Google Analytics, an analytics service provided by Google Inc. (" Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about the use of this website is generally transferred to a Google server in the USA and stored there. However, if the IP anonymisation on this website is activated, prior to this, your IP address will be abridged by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and abridged there. On behalf of Julia Fischer, Google will use this information to evaluate your use of the website, to compile reports on the website activity and to provide Julia Fischer with other services relating to the website usage and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. Julia Fischer points out that on the Google Analytics website the code "gat._anonymizeIp();" has already been added to ensure that only anonymised IP addresses (so-called IP masking) are recorded.


Julia Fischer also uses Google Analytics to evaluate data from AdWords and the double-click cookie for statistical purposes. If this is unwished-for, you can deactivate this using the Ads Preferences Manager (http://www.google.com/settings/ads/onweb/?hl=de).


You may object to the collection, storage and use of data in accordance with sections 1. b., 2. a. to c. at any time.


 

  1. Lawful Basis for the Processing of Personal Data 

 

Insofar as Julia Fischer obtains your consent for the processing of your personal data, GDPR Art. 6(1) point a) serves as the lawful basis for such processing.

 

GDPR Art. 6(1) point b) constitutes the lawful basis for the processing of personal data that is necessary for the performance of a contract. This also applies for any processing that is required in order to take steps prior to entering into a contract.

 

Insofar as the processing of personal data is necessary for compliance with a legal obligation to which Julia Fischer is subject, GDPR Art. 6(1) point c) serves as the lawful basis.

 

 


II. References (Links) to other Websites

 

The website may contain links to websites and offers of other providers. After a link is  clicked, Julia Fischer  no longer has any influence on the processing of any personal data (such as the IP address or the URL on which the link is located) that may have been transmitted to third parties by clicking the link. Julia Fischer cannot accept any responsibility for the processing of such personal data by third parties.


 
III. Conveyance of Inventory and Content Data to Third Parties

Julia Fischer will transfer your personal data to third parties only if this is necessary for the fulfilment of contracts concluded with you or for the performance of the services or if you have given your consent to this. This concerns, for example, service providers for the handling of payments when using a fee-based offer. It is understood that the service providers and cooperation partners of Julia Fischer are likewise obliged to comply with the legal data protection regulations.

You can ask Julia Fischer to confirm whether we process your personal data. If such processing is indeed done, then you can request Julia Fischer for the following information:

  2. the categories of personal data that are processed;
  3. the recipients or categories of recipients to whom your personal data has been or will be disclosed; 
  4. the planned period for which your personal data will be stored, or if no specific details can be given, the criteria used to determine that period;
  5. the existence of the right to request rectification or erasure of your personal data or restriction of processing by the controller, or the right to object to such processing;
  6. the right to lodge a complaint with a supervisory authority;
  7. the existence of automated decision-making, including profiling, referred to in GDPR Art. 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject

 

You are entitled to ask whether the controller intends to transfer your personal data to a third country or international organisation. In this context, you can demand to be notified about the appropriate or suitable safeguards pursuant to GDPR Art. 46 in connection with such transfer.

Vis-à-vis Julia Fischer, you have the right to demand rectification and/or completion if the personal data concerning your person is inaccurate or incomplete. Such correction shall be made by Julia Fischer without undue delay.

You shall have the right to obtain from Julia Fischer the erasure of personal data concerning yourself without undue delay, and Julia Fischer shall have the obligation to erase such data without undue delay where one of the following grounds applies:

  2. you withdraw your consent on which the processing is based, and there is no other legal ground for the processing;

  4. your personal data have been unlawfully processed;
  5. your personal data have to be erased for compliance with a legal obligation under Union or Member State law to which Julia Fischer is subject;
  6. your personal data have been collected in relation to the offer of information society services referred to in GDPR Art. 8(1).

 

  1. Notification of Third Parties

 

Where Julia Fischer has made your personal data public and is obliged pursuant to GDPR Art. 17(1) to erase same, then Julia Fischer, taking account of available technology and the cost of implementation, shall take reasonable steps – including technical measures – to inform controllers processing the personal data that, in your capacity of data subject, you have requested the erasure by such controllers of any links to your personal data and the erasure of any copy or replication of said personal data.

The right to erasure does not apply to the extent that processing is necessary:

 

  1. for exercising the right of freedom of expression and information;
  2. for compliance with a legal obligation which requires processing under Union or Member State law to which Julia Fischer is subject, or for the performance of a task carried out in the public interest;

If in relation to Julia Fischer you have obtained the rectification or erasure of your personal data or restriction of processing, then Julia Fischer shall communicate such rectification or erasure of personal data or restriction of processing to each recipient to whom your personal data have been disclosed, unless this proves impossible or involves disproportionate effort.

 

You have the right to be informed by Julia Fischer about those recipients. 

 

 

  1. Right to Data Portability

 

You have the right to receive the personal data concerning yourself that you have provided to Julia Fischer in a structured, commonly used and machine-readable format. Moreover, you have the right to transmit those data to another controller without hindrance from the controller to whom the personal data was provided, where:

 

  1. the processing is based on consent or on a contract pursuant to GDPR Art. 6(1) point b); and 
  2. the processing is carried out by automated means.

 

In exercising this right, you shall also be entitled to have your personal data transmitted directly from Julia Fischer to another controller, where technically feasible. The rights and freedoms of others may not be adversely affected thereby.

 

The right to data portability shall not apply for the processing of personal data that is necessary for the performance of a task carried out in the public interest.

You have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on GDPR Art. 6(1) points e) or f), including profiling based on those provisions.

 

Julia Fischer shall no longer process your personal data, unless Julia Fischer demonstrates compelling legitimate grounds for the processing which override your own interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

 

Where your personal data are processed for direct marketing purposes, you shall have the right to object at any time to the processing of your personal data for such marketing, which includes profiling to the extent that it is related to such direct marketing.

If you object to processing for direct marketing purposes, then your personal data shall no longer be processed for such purposes.

 

In the context of the use of information society services, and notwithstanding Directive 2002/58/EC, you may exercise your right to object by automated means using technical specifications.

 

 

  1. Right to Withdraw Consent 

 

You have the right at any time to withdraw your consent pursuant to data protection law, without affecting the lawfulness of processing based on such consent before its withdrawal.

 

 

  1. Right to Lodge a Complaint with a Supervisory Authority 

 

Notwithstanding other legal remedies available in court or under administrative law, you have the right to lodge a complaint with a supervisory authority if you are of the opinion that the processing of your personal data is in breach of the GDPR.

 

 

V. Data Security

 

Julia Fischer uses technical and organizational security measures to ensure that your personal data is protected from loss, incorrect changes or unauthorized access by third parties.

 

For example, we use "bcrypt", a well-established password hash function based on the Blowfish cipher, to store your password securely. In any case, Julia Fischer will only allow authorized persons to access your personal data, and only to the extent necessary for the purposes stated above. The transmission of the data collected during registration is encrypted.

 

VI. Changes to the Privacy Policy

 

Julia Fischer reserves the right to update this Privacy Policy. In the event of changes, Julia Fischer will inform you within a reasonable period of time and, if necessary, ask you to give your consent.
